The Personal Empowerment Coach Certification Terms & Conditions

1) You consent to The S.W.A.T. Institute collecting and possessing your name and other "personal information" (as such term is defined in the Personal Information Protection and Electronic Documents Act, 2000, c.5) obtained by us in connection with your registration. You acknowledge and agree that the personal information has been provided to us with your knowledge or consent. In addition, you consent to The S.W.A.T. Institute using, releasing, disclosing and/or retaining on file your name and personal information to:

(i) A company or organization affiliated, associated or related to The S.W.A.T. Institute in order to provide you with information relating to your enrolment with The S.W.A.T. Institute.

2) The Simply Woman Accredited Trainer (S.W.A.T.) Institute Personal Empowerment Coach Certification (PECC) is designed to be an approximate six-month (6) live + interactive education certification program (not including your 30 hours of practice coaching calls that must be completed in order to graduate). You may complete it at your own pace, including completing it faster. However, you have one (1) year to complete your studies. If more time is required beyond one (1) year, you may apply for an extension for a fee. 

3) Our regular fees and method of payment are as set out in our website. However, students who need to extend their studies beyond the one (1) year limit are welcome to apply for an extension with additional fee requirements. Additional fee requirements are currently as follows: $60 USD for a one (1) month extension, $175 USD for a three (3) month extension, $300.00 USD for a six (6) month extension, and $500 USD for an additional twelve (12) month extension. A payment schedule can be provided by contacting our team at [email protected]. All fees must be paid prior to graduation being granted.

4) New S.W.A.T. students have five (5) calendar days from the date of this agreement to cancel their enrolment into The S.W.A.T. Institute and receive a full refund. However, after the fifth (5) day, no refunds or transfers will be issued under any circumstances, nor are you permitted to have someone else take the course. Students who have enrolled in The S.W.A.T. Institute via a payment plan but no longer choose to pursue completion of the program (for whatever reason) will still be required to fulfill the original agreed payment terms.

5) There will be an additional cost for books during your courses. The course curriculum is structured so that you do not have to buy all your books at once. It is suggested that you finish one course, then purchase the corresponding books for the next section. All the book lists are located in “Getting Started” on our learning platform, www.swatlibrary.com. The average total investment for the entire three Modules is between $40 and $80 (depending if you choose e-Book versions or discount sites to buy your books). Ultimately, these books will become a valuable resource for you to use as reference material when coaching clients in your own business. You may also be able to use the cost of the books as a tax deduction. You should consult your own tax advisor with respect to any tax benefit available. The S.W.A.T. Institute is not responsible for ordering, purchasing or shipping books to our students.

6) Students must receive 70 (seventy) percent or higher on their final exam (three submitted coaching calls).

7) The S.W.A.T. Institute will be providing you with proprietary processes, tools, and access to information (the "Confidential Information") that is intended to help create a competitive edge for your future practice. The Confidential Information is for your exclusive use only and not to be disclosed to anyone else except as such disclosure is required by law or a court order. As a student, and a future Certified Empowerment Coach, you shall keep all Confidential Information regarding the certification program confidential and private. You will indemnify and hold The S.W.A.T. Institute harmless against all claims, damages, lost profits, injunctions, orders, judgements, interest, costs and legal fees which may be suffered, directly or indirectly, by The S.W.A.T. Institute by reason of the breach by you of any covenant including the confidentiality provisions contained herein or any other provision of the Terms and Conditions.

8) The S.W.A.T. Institute is committed to the health, safety, and welfare of each of its students and faculty members. The S.W.A.T. Institute does not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behaviour. Upon completing this registration all students are required to adhere to The S.W.A.T. Institute's Code of Ethics Policy. The S.W.A.T. Institute has the right to take action against inappropriate behaviour. 9) The contents of The S.W.A.T. Institute's curriculum are for informational and teaching purposes only. Information contained in The S.W.A.T. Institute's curriculum, and reference to resource material is not intended to diagnose, treat, suggest a course of treatment, cure or prevent any disease, condition or malady. There may be contrary views to any of the material that is published.

10) The information contained in The S.W.A.T. Institute's Empowerment Coach Certification curriculum or obtained as a consequence of using this certification program is not intended to be, nor is it implied to be, a substitute for professional, medical or pharmaceutical advice. Students should always seek the advice of their physician, pharmacist, or other qualified health care provider prior to commencing any treatment for any conditions, diseases or maladies, and questions in relation to such treatment should be directed to such professional health care providers. Students should never disregard their professional medical advice or delay in seeking such advice because of information obtained from this site. 

11) Graduates of The S.W.A.T. Institute are trained to become a Certified Empowerment Coach, not a mental health professional, physical therapist, or psychotherapist. This certification program qualifies the S.W.A.T. graduate to give recommendations to help their clients make more empowered general lifestyle choices. They are not certified to be a nutritionist, dietician, fitness therapist, psychotherapist, mental health professional, alternative health practitioner, or otherwise, and are not intended to diagnose, treat, suggest a course of treatment, cure or prevent any disease, condition, or malady. Graduates should always refer their clients to an appropriate medical professional for any issue arising outside the scope of their S.W.A.T. education. If during a coaching session (whether as a S.W.A.T. graduate, or during the mentorship coaching), a client shows any signs of distress, including but not limited to depression and/or suicidal thoughts, coaches are to direct their clients to immediately call 911.

12) Students and future coaches should never disregard or encourage their client to disregard professional medical advice or delay in seeking such advice because of information obtained from this site.

13) Disclaimer: THE S.W.A.T. INSTITUTE DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS, EXPRESSED OR IMPLIED, IN RESPECT OF THE PRODUCTS AND/OR SERVICES PROVIDED BY THE S.W.A.T. INSTITUTE INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not permit the exclusion of certain implied warranties or conditions or limitations on how long an implied warranty or condition can last in consumer transactions. Therefore, the foregoing disclaimer may not apply to you.

14) Limitation of Liability: THE S.W.A.T. INSTITUTE, ITS OFFICERS, DIRECTORS, AND EMPLOYEES DO NOT ACCEPT LIABILITY WITH RESPECT TO THE SUPPLY OF GOODS AND/OR SERVICES TO YOU FOR LOST PROFITS, LOSS OF BUSINESS OR ANY OTHER LOSS OR DAMAGE RELATING IN ANY WAY TO PRODUCTS AND/OR SERVICES WHETHER SUCH LOSS OR DAMAGE IS DIRECT OR CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE, EVEN IF ADVISED OF THE POSSIBILITY, EVEN IF SUCH LOSS OR DAMAGE OR LIABILITY IS BASED ON NEGLIGENCE OR OTHER TORTS OR BREACH OF CONTRACT INCLUDING, WITHOUT LIMITATION, FUNDAMENTAL BREACH OR BREACH OF A FUNDAMENTAL TERM. Some jurisdictions do not allow the limitation of liability so the foregoing limitation may not apply to you.

15) If a student is undergoing any emotional or mental condition (including addiction) that may, in the sole opinion of The S.W.A.T. Institute, impede them from effectively completing The S.W.A.T. Institute's Empowerment Coach Certification, or from fulfilling their professional responsibilities and competency as a S.W.A.T. Certified Coach, the student/graduate must contact the Professor of Coaching immediately to discuss their continued participation in the program until further diagnosis and treatment has been completed. The consequences include, but are not limited to, termination of instruction without refund.

16) After completing and successfully passing all three modules, our Professor of Coaching at The S.W.A.T. Institute will conduct an evaluation. This evaluation will review the student's grades, her coaching ability, and her code of conduct during the course of her studies. Completion of academic courses does not guarantee certification and approval by The S.W.A.T. Institute. Final certification is at the discretion of the Professor. The S.W.A.T. Institute’s Empowerment Coach Certification Certificate will be issued within four (4) to six (6) weeks after your evaluation has been completed and graduation has been confirmed.

17) There will be no exemptions from any course within the modules.

18) The S.W.A.T. Institute’s Empowerment Coach Certification graduates are eligible to register independently for American Association of Drugless Practitioners (AADP) accreditation. The AADP is a separate organization from The S.W.A.T. Institute and does require its own nominal registration fee should a S.W.A.T. Certified graduate choose to receive AADP accreditation. This accreditation also includes professional benefits from AADP. To learn more you may visit their site at www.aadp.net. They do allow you up to one (1) year after your S.W.A.T. Certification to apply for their accreditation and are internationally recognized.

19) Student academic records / permanent transcript records: These records constitute the permanent record of student performance kept by the Administration Department of The S.W.A.T. Institute. Permanent record information consists of what is required to produce a transcript and includes: a list of all courses attempted and grades achieved, degree attained and date of graduation, academic progress, academic awards and scholarships. The S.W.A.T. Institute will keep transcript records for the duration of Twenty (20) years after graduation. This includes records received and/or maintained in electronic and paper form.

20) Upon successful completion and graduation from The S.W.A.T. Institute, students will continue to have access to The S.W.A.T. Library online learning platform or similar website for life.

21) The relationship between you and The S.W.A.T. Institute and this agreement are governed by the laws of the Province of Ontario, without respect to its conflict of laws principles, and you expressly agree that courts of the Province of Ontario have exclusive jurisdiction with respect to any dispute with The S.W.A.T. Institute in any way relating to this program. Any legal proceedings shall be commenced in the City of Toronto and you attorn to the jurisdiction of the courts of the Province of Ontario.

22) We reserve the right to change the Terms and Conditions at any time without notice. If these conditions change, you agree to abide by the most recent version of the Terms and Conditions each time you view and use the website www.swatlibrary.com. You are accordingly advised to consult the Terms and Conditions each time you view and use the website www.swatlibrary.com. Do not use the website if you do not agree to all of the Terms and Conditions.

23) If any provision of the Terms and Conditions is unenforceable, invalid or in conflict with the laws of any relevant jurisdiction, such provision shall be inoperative only to the extent that it is in conflict with the laws of such jurisdiction, and the validity and enforceability of the balance of any provision and the remaining provisions shall not be affected. The Terms and Conditions supersedes all prior agreements, understandings, negotiations and discussions whether, oral or written, pertaining to this subject matter herein.
